This Candidate Privacy Policy (hereinafter the “Policy”) contains provisions which apply to the processing of your personal data when you apply for a position to the Company (hereinafter the “Recruitment process”). This Policy is an integral part of the Privacy Policy of the Website. The provisions which are not governed by this Policy are governed by the Privacy Policy of the Website.

  1. PERSONAL DATA PROCESSED BY THE COMPANY.
    1. Personal data you provide to the Company.
      1. Personal data you provide when you apply for a position. When you: a) apply to the Company through the interface of its Website; or b) apply to the Company through the interface of E-recruitment platform or social media; or c) apply to the Company through other means of communication (for example, by sending an application to the employee/subcontractor/affiliate of the Company directly); d) apply via e-mail address job@evoplay.games; or e) apply by other means; you provide the Company with the following data concerning you:
        • a. Your application (hereinafter the “Application Data”). These include your full name, e-mail address, telephone number, Curriculum Vitae (CV) – including all information contained in it, portfolio (for specific positions), letter(s) of recommendation (if any), your cover letter (if applicable), the information about your referrer (if any), other applicable annexes.
        • b. Your documents (hereinafter the “Documents Data”). These include, but not limited to, a copy of your identification document (passport, ID card), a copy of your Taxpayer Number (or similar document applicable in your jurisdiction), a copy(copies) of your educational documents and certificates, a copy of your employment book (or another document on your employment history which is applicable in your jurisdiction), the information on your work permit and visa information.
      2. Interview Data. When you pass an interview or discuss with an employee of the Company the position you are applying for, you provide to the Company the information (hereinafter the “Interview Data”) that may fall within the definition of “personal data” under the Article 4(1) of the GDPR. Interview Data includes, but not limited to:
        • a. Your desired salary or monthly rate of remuneration, the information about your wiliness to relocate, other information on your preferences;
        • b. Information about your professional background/job experience, academic background;
        • c. If disclosed, information about your gender;
        • d. Interview details, and outcomes of test assignments you complete;
        • e. Information about your skills, qualifications, and competencies;
        • f. Information about your interests or hobbies;
        • g. Information on whether or not you are subject to any prior employer obligations;
        • h. Information about your membership in a trade union (if applicable);
        • i. Contact details of your former employer, colleagues, academic supervisor (if applicable);
        • j. If disclosed, any special needs or health condition and information relating to accommodations that may be needed by your particular situation (for candidates with special needs);
        • k. Other Information that you may provide to us.
    2. The data collected from third parties. The Company may collect information about you from third parties (hereinafter the “Third Parties Data”):
      • a. Social Media and web-platforms (Facebook, LinkedIn, Vk.com, GitHub, Dou.ua and other related sources);
      • b. Public registers, other publicly available sources;
      • c. Feedback(s) from your previous place(s) of employment/previous duty station. For example, if you provide Us with a letter of recommendation from your previous place of employment, the Company may contact with the issuer of the recommendation in order to discuss your performance, achievements, professional competences, and other details specified in the letter of recommendation;
      • d. Feedback(s) from your former colleagues or academic supervisor.

      Note: points “c.” and “d.” are applicable only upon your explicit consent to these communications.

  2. THE PURPOSES AND LEGAL BASES FOR THE PROCESSING.
    1. The Company will process your personal data for the following purposes:
      • a. To process your application and evaluate your candidature. The Company uses Application Data, Interview Data and Third Parties Data for the following purposes:
        • To receive, review and reply to your application;
        • To facilitate the Interview(s)/Recruitment process;
        • To evaluate whether your candidature is suitable for the position that you are applying for, or, if applicable, for other positions at the Company;
        • To evaluate whether your desired salary or a monthly rate of remuneration falls within the budget allocated for this position;
        • In case if your candidature was proposed by the referrer, to inform the latter on the outcome of your application.

        Notification about the legal bases for the processing in accordance with the GDPR: a) Article 6(1)(b) of the GDPR – processing is necessary for the performance of a contract to which you are party or in order to take steps at the request of your prior to entering into a contract; and b) Article 6(1)(f) of the GDPR: the processing is necessary for the purposes of the legitimate interests pursued by the Company and the third party (the performance of the Interview(s)/Recruitment processes is the legitimate interest of the Company).

      • b. To propose you other positions in the Company.If your candidature matches with another position in the Company, we may use your personal data in order to propose you this position. Additionally, if your candidature has not been chosen for a position you have applied for, the Company may use your personal data to propose you other position (current and future).

        Notification about the legal basis for the processing in accordance with the GDPR: Article 6(1)(b) of the GDPR: the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract.

      • c. To verify the information about you (to the extent permitted by applicable law). The Company uses your Documents Data for the following purposes:
        • To verify your identity;
        • To verify your academic background and education history (the Company verifies your educational documents and certificates);
        • To verify your employment history and professional background;
        • To verify your identity via state registers. The Company verifies that you are a legally capable person and has no legal and other restrictions that may prevent you from being employed by the Company;
        • To verify that the information you provide in your Application or during the Interviews corresponds to reality

        Notification about the legal basis for the processing in accordance with the GDPR: Article 6(1)(f) of the GDPR: the processing is necessary for the purposes of the legitimate interests pursued by the Company and the third party. The verification of the information about you is the legitimate interest of the Company.

      • d. To improve and manage the Recruitment process of the Company. The Company uses your personal data for the following purposes:
        • To manage and improve its Recruitment process;
        • To conduct an analysis of the effectiveness of its Recruitment process.

        Notification about the legal basis for the processing in accordance with the GDPR: Article 6(1)(f) of the GDPR: the processing is necessary for the purposes of the legitimate interests pursued by the Company and the third party. Improvement and management of the Recruitment process of the Company is its legitimate interest.

      • e. To perform legal obligations of the Company under applicable legislation.

        Notification about the legal basis for the processing in accordance with the GDPR: Article 6(1)(с) of the GDPR – the processing is necessary for compliance with a legal obligation to which the Company is subject.

      • f. To hire you for a position you have applied for (if your candidature is chosen for a position).

        Notification about the legal basis for the processing in accordance with the GDPR: Article 6(1)(b) of the GDPR: the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract.

  3. TO WHAT RECIPIENTS YOUR PERSONAL DATA TO BE DISCLOSED?
    1. The staff of the Company, its contractors and affiliates. During the Recruitment process, your personal data may be disclosed to the staff of the Company or to other parts of its group of undertakings (for example, affiliated legal entities, subsidiaries). These may include employees of the department you are applying to, human resources department, legal department, security department, other departments (if the situation so requires).
    2. Third-party auditors, third-party providers of security services. The Company may perform verification with the help of third-party providers of security services. Thus, your Documents Data may be shared with them for that purpose. For some positions, the Company may engage third-party auditors in order to evaluate your candidature (including Interviews, recruiting exercises or test assignments).

      Note: recipients, mentioned in paragraphs “4.1” and “4.2” have singed proper data transfer agreements with the Company. These agreements oblige these recipients to process your personal data in accordance with this Policy and data protection legislation in force in the European Union.

    3. Public Authorities. This includes court, police, other public bodies. That disclosure may be performed only subject to the legal obligation to which the Company is subject.
  4. THE PERIOD FOR WHICH YOUR DATA WILL BE STORED.
    1. Your personal data shall be stored for a period required for the purposes of this Policy. If you are hired to a position, your personal data collected under this Policy shall be retained by the Company as a part of your employee records.
  5. INTERNATIONAL DATA TRANSFERS.
    1. The Company does business globally and some parts of our group of undertakings may be located in jurisdictions (countries) that are not EU Member States. Thus, during your Recruitment process, your personal data may be transferred to the country/countries that is/are not subject of the adequacy decisions of the European Commission (in a plain language, with the data protection legislation, different to the EU one). By agreeing to this Policy, you hereby agree to these transfers.
